Gallagher \" width=\"156\" height=\"187\" \/><\/a>As a <a title=\"LA DUI lawyers\" href=\"http:\/\/www.socaldefenselawyer.com\" target=\"_blank\" rel=\"noopener noreferrer\">California DUI lawyer<\/a> I often get questions from potential clients about the California DMV hearing. \u00a0 \u00a0The potential client has usually been researching the law about APS or &#8220;admin per se&#8221; California\u00a0<a title=\"DMV hearings after a California DUI\" href=\"http:\/\/www.socaldefenselawyer.com\/dui.php\" target=\"_blank\" rel=\"noopener noreferrer\">DMV hearings after an arrest for DUI in California<\/a>.\u00a0 \u00a0 After the initial research it is time to set the hearing and they need to know what&#8217;s best for a California DMV hearing&#8230;.telephonic or in person? \u00a0 And that&#8217;s about the time they pick up the phone and call me. \u00a0Some callers want to know because they plan on conducting their own California DMV hearing. \u00a0 Other callers are just reading off a checklist they printed from another DUI lawyer&#8217;s webpage called , &#8220;Questions to ask before hiring a DUI lawyer&#8221;.<\/p>\n<p>Let&#8217;s start with a little background about the California DMV hearing process after a DUI arrest. \u00a0 When you get stopped for DUI in California the officer will generally confiscate your California Drivers License and hand you a pink sheet of paper. \u00a0Some people refer to this paper as a temporary license, others refer to it as an APS notice of suspension, and still others like to call it the DS-367. \u00a0 Call it what you like, but something is not right. \u00a0 Your drivers license is gone, and you are left holding a pink piece of paper, this is not a good situation. \u00a0 The pink paper it&#8217;s good for 30 days, but is it really? \u00a0And what&#8217;s this business about 10 days?<\/p>\n<p>The important concept is that in California an automatic license suspension in already underway the minute you receive that pink sheet of paper. \u00a0 \u00a0Don&#8217;t think you can wait for your court date months from now to fight your case. \u00a0If you want to save your drivers license, you need to <a title=\"California DUI lawyers\" href=\"http:\/\/www.socaldefenselawyers.com\" target=\"_blank\" rel=\"noopener noreferrer\">take action and start fighting right away<\/a>. \u00a0 \u00a0If you do nothing, your LICENSE WILL BE SUSPENDED on day 31 and the suspension will last for 120 days. \u00a0 So while the temporary license is good for 30 days, it&#8217;s a ticking time bomb. \u00a0 To stop the automatic suspension after a California DUI arrest, you need to demand a California DMV hearing within 10 days of your arrest. \u00a0 If \u00a0you fail to make the request in 10 days, you lose your right to a hearing and you are an automatic loser. \u00a0 \u00a0And that brings us back to our original question of which is better&#8230; A telephonic hearing? Or an in person California DMV hearing?<\/p>\n<p>Many <a title=\"California DUI lawyers\" href=\"http:\/\/www.socaldefenselawyers.com\" target=\"_blank\" rel=\"noopener noreferrer\">California DUI lawyers<\/a> will give you a big speech about why you should always do the hearing in person. \u00a0The theory is that the telephonic hearing gives the DMV some sort of advantage. \u00a0 These attorneys will tell you that DUI lawyers who do telephonic hearings aren&#8217;t doing a good job fighting your case. \u00a0 I&#8217;m calling bullshit on this one. \u00a0 It&#8217;s just another piece of legal marketing disguised as helpful advice. \u00a0 The truth is that there are advantages to both types of California DMV hearing. \u00a0 To determine which type of hearing is right for your case will require a careful analysis.<\/p>\n<p>The &#8220;in person&#8221; California DMV hearing provides for a far better opportunity to present <a title=\"Anybody up for some Widmark charts?\" href=\"http:\/\/www.google.com\/imgres?hl=en&amp;sa=X&amp;tbo=d&amp;biw=1280&amp;bih=869&amp;tbm=isch&amp;tbnid=ZYUdocEZehLCLM:&amp;imgrefurl=http:\/\/www.danaise.com\/toxicology.htm&amp;docid=PYWAdSfylLYPtM&amp;imgurl=http:\/\/www.danaise.com\/brac%252520bac%2525202.jpg&amp;w=1439&amp;h=1125&amp;ei=sIbLUOSkCsqjigKr1YGYCw&amp;zoom=1&amp;iact=hc&amp;vpx=4&amp;vpy=123&amp;dur=1438&amp;hovh=198&amp;hovw=254&amp;tx=117&amp;ty=125&amp;sig=105697390750252789056&amp;page=1&amp;tbnh=135&amp;tbnw=179&amp;start=0&amp;ndsp=39&amp;ved=1t:429,r:0,s:0,i:91\" target=\"_blank\" rel=\"noopener noreferrer\">visual evidence<\/a>. \u00a0If you plan on presenting photos, graphs, diagrams, video, and the like, a telephonic hearing is a terrible idea. \u00a0 The &#8220;in person&#8221; hearing is also usually better for conducting cross examination. \u00a0 You can read a witness much better in person than over the phone, and non verbal clues can also help the hearing officer determine the\u00a0<a title=\"Are you telling us the truth?\" href=\"http:\/\/www.google.com\/imgres?imgurl=http:\/\/upload.wikimedia.org\/wikipedia\/commons\/thumb\/c\/c8\/O.J._Simpson_1990_%C2%B7_DN-ST-91-03444_crop.JPEG\/220px-O.J._Simpson_1990_%C2%B7_DN-ST-91-03444_crop.JPEG&amp;imgrefurl=http:\/\/en.wikipedia.org\/wiki\/O._J._Simpson&amp;h=162&amp;w=123&amp;sz=1&amp;tbnid=dfralmC4S16FiM:&amp;tbnh=162&amp;tbnw=123&amp;zoom=1&amp;usg=__XKNjPAcpiMb9X9BpEhA-ERBVeZc=&amp;docid=-CQJ6jLSkFNSTM&amp;itg=1&amp;hl=en&amp;sa=X&amp;ei=8IbLUMHuLqKoiQL374GYBQ&amp;sqi=2&amp;ved=0CKoBEPwdMAw\" target=\"_blank\" rel=\"noopener noreferrer\">credibility of the witness<\/a>. \u00a0 A telephonic hearing also has advantages. \u00a0 If I have a witness or client that is nervous or otherwise uncomfortable giving testimony, it may be easier to protect my client in a telephonic hearing. \u00a0 \u00a0Doing a telephonic California DMV hearing also gives me home field advantage. \u00a0 With access to my computer, my library, and unlimited set up time, I can be ready for battle. \u00a0 &#8220;In person&#8221; hearings are held at the driver safety field offices and they inherently involve a little road game. You are loading your materials into the car and setting up for the hearing on the opposing teams home field. \u00a0 \u00a0 Knowing more about the particular hearing officer conducting your California DMV hearing is also important. \u00a0 An <a title=\"13 years handling DUI cases\" href=\"http:\/\/www.markagallagher.com\" target=\"_blank\" rel=\"noopener noreferrer\">experienced DUI lawyer<\/a> will know which hearing officers are easier in person, and which ones are easier on the phone.<\/p>\n<p>So which type of California DMV hearing is better?
