What\u2019s too fast? \u00a0<strong>Vehicle Code (VC) 23582\u00a0<\/strong>says that if you are guilty of a DUI and were driving <strong>30 mph over the speed limit<\/strong> <strong>on a freeway<\/strong>, or <strong>20 mph over the speed limit on any street or highway<\/strong> when you got that DUI,\u00a0<strong>PLUS<\/strong>\u00a0you were driving in violation of VC 23103 (reckless driving), you face a mandatory minimum of 60 days in jail.<\/p>\n<p>So in sum, the formula is: <strong>DUI + too fast + reckless<\/strong> = judge will sentence you to 60 days in jail. \u00a0When charged with the speed enhancement, the \u201ctoo fast\u201d and \u201creckless\u201d portions are two elements but will be considered as one \u201cspeed enhancement.\u201d<\/p>\n<p>So what if you being charged with a DUI, are facing a speed enhancement,\u00a0<strong>BUT<\/strong>\u00a0you\u2019d like to keep your ass out of jail? \u00a0Well, the only way to stay out of jail is to get\u00a0the DA to drop the speed enhancement.
