{"id":1229,"date":"2012-02-14T01:48:10","date_gmt":"2012-02-14T01:48:10","guid":{"rendered":"http:\/\/www.markagallagher.com\/socaldefenselawyers\/getting-your-exspouse-pay-for-your-attorney-fees-family-law-case\/"},"modified":"2020-10-30T20:48:08","modified_gmt":"2020-10-30T20:48:08","slug":"getting-your-exspouse-pay-for-your-attorney-fees-family-law-case","status":"publish","type":"post","link":"https:\/\/www.markagallagher.com\/socaldefenselawyers\/getting-your-exspouse-pay-for-your-attorney-fees-family-law-case\/","title":{"rendered":"Getting Your Ex-Spouse to Pay for Your Attorney Fees in a Family Law Case"},"content":{"rendered":"<p><a href=\"http:\/\/www.flockoflegals.com\/wp-content\/uploads\/2012\/01\/lisa-headshot.jpg\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignleft size-medium wp-image-1133\" title=\"lisa headshot\" src=\"http:\/\/www.flockoflegals.com\/wp-content\/uploads\/2012\/01\/lisa-headshot-300x273.jpg\" alt=\"\" width=\"300\" height=\"273\" \/><\/a>Many people think that they have to pay an attorney upfront in any type of proceeding.\u00a0 That is not quite true.\u00a0 While many attorneys have high rates, there are many areas of law that do not require a person to pay for the attorney\u2019s fees upfront.\u00a0 For example, person injury attorneys get paid only if you win or settle your case.\u00a0 Criminal law is its own species that often requires a lump sum down payment anywhere from a thousand dollars generally for simple matters to tens of thousands of dollars for more complicated matters.\u00a0 In criminal law, if you cannot afford an attorney, the court will appoint one to you for free.\u00a0 Family law operates on a different level where a party may be entitled to have the spouse pay a portion of the attorney\u2019s fees.<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Retainers<\/strong><\/p>\n<p>First, what is a retainer?\u00a0 A retainer is an amount put down by a person in advance for the attorney\u2019s services.\u00a0 This money is then put in a trust account.\u00a0 When an attorney does work, they can withdraw from the money in the retainer.\u00a0 Depending on the attorney, you will most likely get a billing statement at the end of the month detailing the work that has been done on your case and the amount that is going to be taken out of the trust account.\u00a0 At the end of your case, any amount that is left over should be returned to you.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Getting your spouse to help share the cost of YOUR attorney fees<\/strong><\/p>\n<p>You may be entitled to attorney fess and costs that are awarded immediately from the outset of a case upon the showing that:<\/p>\n<p>(1) your respective incomes and needs of you and your spouse,<\/p>\n<p>(2) there is a disparity in you and your spouse\u2019s access to money to retain an attorney, and<\/p>\n<p>(3) that your spouse is able to pay for legal representation of both parties.<\/p>\n<p><a href=\"http:\/\/law.onecle.com\/california\/family\/2030.html\">Family Code section 2030(a)(2<\/a>) states that If the findings demonstrate disparity in access and ability to pay, then the court shall order attorney fess and costs.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Public Policy<\/strong><\/p>\n<p>It is a matter of public policy to make sure that each party going through a separation (or nullity) has equal access to legal representation.\u00a0 This section of the Family Code is in place to prevent a situation where the spouse who holds the \u201cpurse strings\u201d is able to afford more and better divorce attorneys than the other spouse.\u00a0 Thus, courts will generally outright deny a party\u2019s request for attorney\u2019s fees at the off set of a case when all of the conditions mentioned above have been met.<\/p>\n<p>What does this mean?
